What Rio Salado Villas Condominium Association's governing documents say
Rio Salado Villas is a condominium community in Tempe, AZ. These Bylaws supplement the CC&Rs and govern association operations, voting, assessments, and maintenance. They apply to all unit owners, who are members of the association with one vote per unit.
- Voting & Elections: Each unit owner gets one vote. Elections are by mailed ballot with a 30-day return period. Quorum is based on ballots returned within that period. Voting rights are suspended if dues are not current. Bylaw changes, officer elections, and special assessments require 2/3 approval of returned eligible ballots.
- Dues & Assessments: Monthly assessments are due on the 1st, delinquent on the 16th with a $10 late fee. Dues can be increased without a membership vote by no more than the CPI-U index; any increase above that needs 2/3 approval of returned ballots. Special assessments also require 2/3 approval of returned eligible votes.
- Delinquency & Water Termination: If dues are unpaid for two consecutive months, a water termination notice is posted on the unit door. On the 16th of the third month of non-payment, water service is terminated. For special assessments, the notice is posted 30 days after assessment date and water terminated on the 60th day.
- Maintenance Responsibilities: The association repairs defects in common elements (e.g., roof leaks). The unit owner is responsible for internal damage resulting from the common element defect (e.g., painting and repairing the ceiling after the roof leak is fixed).
- Board of Directors: The board consists of 4 members elected from the general membership, serving 2-year staggered terms with no term limits. Candidates must reside close enough for weekly inspections. Board members serve without compensation and must be current on dues. Vacancies are filled by majority vote of remaining board members.
- Meetings: An annual membership meeting is held in November or December with at least 30 days' mailed notice. Special meetings can be called by written request of one-quarter of eligible voting members.
