Butterfield Stagecoach Farms is a single-family lot subdivision in Tonopah, AZ governed by a Declaration of Covenants, Conditions, and Restrictions (CC&Rs) that run with the land. This document sets use and maintenance rules for owners and tenants, but does not create a homeowners association, common areas, or mandatory assessments. Enforcement is by any lot owner.
- Permitted uses: Lots may be used only for residential, recreational, and agricultural purposes. No retail or public-inviting nonresidential uses are allowed, except as required by fair housing laws.
- Leasing & rentals: An owner may lease a lot, but only the entire lot with its improvements — no partial rentals. The tenant must agree to abide by the Declaration.
- Animals: A reasonable number of animals is allowed, subject to zoning. Animals must not create unreasonable noise or nuisance, and may not roam onto other lots. Animals may be kept only after a dwelling or appropriate fencing is built, or when the owner is present.
- Temporary occupancy & structures: No trailer, tent, shack, garage, barn, stable, or temporary building may be used as a residence, even temporarily. Temporary construction structures must be removed after completion.
- Nuisance & maintenance: No nuisance, noxious activity, or unlawful use is permitted. Lots must be kept free of weeds, debris, and unsightly accumulations. Buildings and landscaping must be kept in good repair.
- Vehicles & parking: Vehicles (including RVs, boats, trailers) must be in operating condition with current registration. Lots may not be used primarily for vehicle storage.
- Signs: Signs visible from neighboring property are prohibited except: one real estate "For Sale or Lease" sign (post-mounted, max 18x24 inches), and one residential identification sign (max 2 square feet).
- Duration & amendments: The CC&Rs run for 20 years from recording (1996) and automatically renew for 10-year periods unless 90% of owners vote to revoke. Amendments require >2/3 of lot owners (plus Declarant's consent while Declarant owns any lots) and must be recorded.
