Sugar Ridge Farms is a single-family residential subdivision in Nash County, NC, governed by a Declaration of Restrictive Covenants. These covenants bind all lot owners and are enforced by the original developers (Declarants) or their delegates, and they cover residential use, building standards, and property maintenance.
- Residential use & building size: Each lot is for one detached single-family home only, with minimum heated floor areas: 1,800 sq ft for one-story, 2,000 sq ft for one-and-a-half or two-story, and 2,000 sq ft (excluding third floor) for two-and-a-half story homes. No mobile, manufactured, or modular homes are allowed.
- Lot size & setbacks: Lots cannot be subdivided below 30,000 sq ft or 100 ft width at the building setback line. Buildings must be at least 50 ft from the front lot line, 25 ft from side street lines, 15 ft from interior lot lines, and 30 ft from the rear lot line.
- Architectural review: All structures, fences, driveways, pools, and other improvements require written approval from the Declarants (or their delegate) before construction. Approval is at their sole discretion, and if no decision is made within 30 days of submission, approval is deemed granted.
- Construction timeline: Once construction begins, it must be completed within 12 months from start or building permit issuance, whichever comes first, unless the Declarants grant an extension for hardship.
- Property maintenance & appearance: Owners must keep lots free of tall grass, undergrowth, dead trees, trash, and rubbish. Erosion control measures (like silt fences) must be maintained during and after construction. No exposed above-ground fuel or water tanks are allowed unless screened.
- Use restrictions: Lots are for residential purposes only. Outside clotheslines are limited to umbrella-style (max 48" diameter) and not visible from the road. Commercial signs are limited to one 'For Sale' or 'For Rent' sign (max 2x3 ft). No house trailers or temporary buildings are allowed except during construction, and they must be removed within 10 days after a certificate of occupancy.
- Pets & livestock: Livestock, poultry, and similar animals are prohibited without written permission from the Declarants. A reasonable number of household pets is allowed, provided they are not raised commercially and any outdoor enclosure is in the rear yard.
- Prohibited activities: Noxious, offensive, or loud activities are banned. Owners must avoid anything that causes embarrassment, discomfort, annoyance, or nuisance to the neighborhood. Motor vehicle assembly/disassembly and similar hobbies that create unsightly conditions are not allowed.
