What Retta Oaks Ranch's governing documents say
Retta Oaks Ranch is a single-family home subdivision near Rendon, TX. These documents create a separate sub-association (Retta Oaks Ranch Lake Homeowners Association) for seven specific lots (Lots 1–3, 5–7 of Block 2) that share a common lake area. The rules bind the owners of those lake lots and cover their use of the lake, assessments, and architectural controls. There is also a separate amendment regarding an initial contribution fee upon sale for all lots in the larger Retta Estates subdivision.
- Lake Lot Assessments & Fees: Each lake lot owner pays an annual assessment of $500 initially, due January 31. The board can increase it up to 10% per year without a vote; beyond that requires approval of two-thirds of members. Special assessments may be levied by member vote. Unpaid assessments bear 18% annual interest and can become a lien foreclosed by non-judicial sale. Additionally, an amendment for the larger Retta Estates subdivision imposes an $800 initial contribution due at each sale of a lot with a completed dwelling, adjustable up to 10% per year by the board.
- Land Use & Lake Restrictions: No docks, piers, or similar structures are allowed on the lake. Level concrete patios are permitted at the water's edge with ACC approval, must match the house exterior, and may extend up to 4 feet into the water. Only motorless boats or boats with electric motors, no longer than 12 feet, are allowed. Swimming is prohibited. Catch-and-release fishing is allowed from a boat or the owner's bank.
- Architectural Control: Outbuildings and rear-yard fences require approval from the Architectural Control Committee (or Developer before control transfer). Patios along the lake also need ACC approval per the above restrictions.
- Lake Association Governance: A separate Lake Association governs the lake lots. Developer controls it until the earlier of: no longer owning any part of the subdivision, 15 years from recordation, or voluntary relinquishment. Thereafter, owners elect a board of at least 3 directors with staggered 3-year terms. Each lake lot gets one vote (Developer gets 10 votes per tract it owns).
- Enforcement & Penalties: Violations after 10-day written notice can be cured by the Association at the owner's expense, plus a daily charge of $50 (adjusted for inflation) until corrected. Failure to pay can result in a lien. The Association may also sue for compliance and recover attorney's fees.
- Term & Amendments: The lake lot restrictions run for 40 years from the recording date (2023) and auto-renew for 20-year periods unless canceled by a two-thirds member vote. Amendments require a two-thirds vote; Developer may amend unilaterally before the control transfer date as long as it owns at least one tract and the amendment is consistent with the development plan.
