Gila Butte Estates is a single-family home subdivision in Chandler, AZ, governed by a Declaration of Restrictions that replaced earlier rules. These covenants apply to all lots and owners, focusing on residential use, construction standards, and property maintenance. There is no homeowners association; enforcement is by individual lot owners.
- Use restrictions (single-family only): All lots are for single-family residential use only. No business activities of any kind are permitted. Temporary structures (trailers, tents, shacks) cannot be used as residences, and no structure may be occupied before it is near completion.
- Building requirements (minimum size, setbacks, approval): Each residence must have at least 1,600 square feet of ground floor area (excluding open porches, pergolas, or attached garage). Setbacks are 40 feet from front and rear property lines, and 20 feet from side lines. All construction plans and materials require written approval from Glenars Land Company, and exterior surfaces must be finished or natural material.
- Livestock: Lot owners may keep livestock as a hobby, provided it is properly fenced or stalled per county regulations and not raised for commercial gain. Pigs, hogs, goats, and poultry are specifically prohibited. A stable, livestock shelter, or tack room must be at least 24x20 feet, harmonious with the residence, and set back 40 feet from the rear lot line and 20 feet from side lines.
- Parking & vehicles: Private passenger cars and pickup-class trucks may be parked on the lot front or sides. Larger trucks, boats, camping trailers, and recreational vehicles must be kept in a garage or screened from view. No trailer larger than a camping trailer may be stored on any lot.
- Antenna & fences: No exterior antenna or broadcasting tower is allowed except a TV antenna extending no more than 8 feet above the roof. Fences within 100 feet of the front lot line must be made of block, steel, chain link, or wood with specified post and rail dimensions.
- Lot maintenance & nuisances: Owners must keep lots free of weeds and trash. If not, the subdivider may clean the lot twice yearly and charge up to $100 annually, which becomes a lien. No nuisance activities are permitted, and all rubbish, trash, and garbage must be removed promptly.
- Enforcement and term: These covenants run with the land until January 1, 1994, and automatically renew for successive 10-year periods unless a majority of lot owners vote to change them. Violations may be enforced by any other lot owner through court action for damages or injunction. Invalidity of one restriction does not affect others.
