It runs with the land and requires each parcel to pay water replenishment fees to the Central Arizona Groundwater Replenishment District (CAWCD) to help secure an assured water supply. This document is not a full community rulebook—it only covers groundwater-related obligations.
- Replenishment Assessment: An annual assessment levied by CAWCD against each parcel based on the parcel's groundwater use (Parcel Replenishment Obligation). If unpaid, it becomes a lien on the property and a personal obligation of the owner.
- Activation Fee: A one-time fee set by CAWCD per housing unit, paid by the owner before the state real estate commissioner issues a public report authorizing sale or lease of any subdivided lot. Nonpayment results in interest, costs, and penalties.
- Replenishment Reserve Fee: A fee for parcels qualifying as Category 1 member land, based on a pro rata share of projected annual excess groundwater demand. Must be paid before a public report is issued, or long-term storage credits may be assigned instead.
- Lien & Personal Obligation: All unpaid replenishment assessments, activation fees, and reserve fees constitute a continuing lien on the parcel and are also a personal debt of the owner at the time they became due. CAWCD may enforce collection under Arizona law.
- Binding Effect & Amendments: These covenants run with the land and bind all current and future owners. Amendments require the written agreement of CAWCD, the Arizona Department of Water Resources, and owners of 67% of the total property area.
