The association manages maintenance, insurance, and common expenses, and your rights are subject to this declaration, the articles, and bylaws.
- What you own & maintain: You own the interior space of your unit (walls, floors, ceiling, patio) and are responsible for maintenance, repairs, and decorating inside your unit and any exclusive HVAC components. The association maintains the common elements (roof, structure, parking, landscaping, etc.).
- Assessments & liens: Each owner pays a proportionate share of common expenses based on their 6.25% interest. Late charges up to 10%, plus interest at 18% per annum, may be added. Unpaid assessments become a lien on the unit, subordinate to a first mortgage, and can be foreclosed like a mortgage.
- Parking: Each unit is assigned one parking space (part of common elements) with an exclusive easement. Parking easements cannot be transferred separately from the unit, except by exchange with board and mortgagee consent. The association maintains a list of authorized users.
- Alterations & decorating: Nonstructural interior alterations do not require board approval, but must not damage other units or common elements. Any alteration to patios or common elements requires board approval. Structural additions need majority owner and all first mortgagee approval. Visible draperies, shades, and curtains are subject to board regulation on color or design.
- Insurance: The association carries casualty insurance (at least 90% replacement cost), public liability ($1M per injury, $5M per occurrence), workers' comp, and fidelity bonds (150% of annual budget). Owners may get their own insurance for furnishings and personal liability, but it must not impair association policies.
- Destruction, condemnation & obsolescence: Partial damage/condemnation/obsolescence is restored by the association without a vote. Substantial (cost > 50% of restored value) requires 75% owner consent and unanimous institutional holder consent to restore; otherwise, the property is sold and condominium terminates. Special assessments for restoration are secured by a lien.
- Mortgages & lender protections: Each owner may mortgage their unit individually, but cannot encumber common elements.
