Broken Arrow Ranch Condominiums (Fountain Hills, AZ) is a condominium community governed by this Declaration. You own your unit's interior; the association maintains common elements. Leases must be for at least 30 days, and no more than two dogs, cats, or household birds are allowed per unit.
- Residential use & home businesses: Units are for residential use only. Limited home businesses are allowed if not visible or detectable from outside, comply with zoning, and do not involve client visits or solicitation.
- Pets: No more than two domestic pets (dog, cat, or household bird) per unit. Dogs must be leashed outside the unit. No pet relief on common elements; structures for pets must not be visible from outside the building.
- Leasing & rentals: Leases must be in writing, for the entire unit, for at least 30 days. Unit owners must notify the association of lease start/end dates and occupant names. Leases must incorporate the condominium documents.
- Maintenance responsibilities: The association maintains all common elements. Unit owners maintain their unit interior and certain limited common elements (e.g., exterior doors/windows, patio, storage, parking space). Owners are liable for damage caused by their negligence.
- Parking & vehicles: No trucks, trailers, campers, boats, recreational vehicles, or inoperable vehicles may be parked on the property. No vehicle repair (except emergencies) is allowed. The board may tow violators at owner expense.
- Signs & exterior alterations: No signs except a name/address sign no larger than 9x30 inches. Exterior alterations, including window coverings and antennas, require board approval.
- Assessments & budgets: The board adopts an annual budget and assesses common expenses equally per unit (1/5th each). Special assessments may be levied. Failure to pay results in a lien and enforcement remedies.
- Developer rights: During the period of declarant control (ending when 75% of units sold or 4 years after last unit sale), the declarant retains certain rights, including appointing the board and modifying the declaration.
