Doubletree Condominiums Phase II is a condominium community in Fountain Hills, Arizona, where you own your individual unit interior and share ownership of the building structure and common grounds (managed and maintained by the association). As a unit owner, you must follow use and alteration restrictions and carry insurance on your unit, and you'll pay assessments for common expenses allocated equally per unit.
- What you own & maintain: You own your unit interior (bounded by exterior walls and roof) and limited common elements assigned to you (your patio/yard, individual utility meters). The association maintains the building structure, common grounds, and shared infrastructure. If the association fails to maintain common elements, you're responsible for maintaining those contiguous to your unit.
- Architectural review & approval: External changes (color, texture, solar devices, satellite dishes, antennas, telescopes) visible from a neighboring property require written approval from the adjacent unit owner. The Fountain Hills Neighborhood Committee of Architecture also has jurisdiction; if rules conflict, the most restrictive applies.
- Use restrictions: Units are for single-family residential use only—no business, trade, or profession, though you may maintain a personal professional library, keep records, or handle calls from your unit. No external clotheslines, no motor vehicle repair or storage of inoperable vehicles visible from neighboring property. You must comply with Fountain Hills covenants.
- Alterations & modifications: Interior non-structural changes don't require advance approval, but you're liable for any damage to adjacent units or common elements. Structural alterations and any exterior color or texture changes require prior written approval from the owner of the adjacent unit (sharing your party wall).
- Assessments & fees: Common expenses are assessed equally per unit, based on the budget adopted by the board. Assessment liens are subordinate to mortgages; if a unit is foreclosed, unpaid prior assessments are extinguished for the new owner but reallocated to all remaining units.
- Insurance requirements: You must carry fire, casualty, and liability insurance on your unit at full replacement value with a B+ or better rated carrier. If the association doesn't specify an amount, you must maintain at least $500,000 in joint liability insurance with the adjacent unit owner.
- Governance: The association is a nonprofit Arizona corporation. During the developer's 90-day "Period of Declarant Control" (after all units are sold), the developer appoints the board and officers. Thereafter, unit owners elect a board of at least two members (both must be unit owners), who then elect officers.
- Parking & vehicles: No motor vehicle construction, repair, or servicing may be visible from neighboring property, except for emergency repairs. Inoperable vehicles cannot be stored or parked anywhere visible from neighboring property. During the sales period, the developer may restrict non-allocated parking spaces for sales, model, and construction activities.
