La Vida Buena is a condominium community in Fountain Hills, AZ — you own your individual unit and share ownership of the building's common elements. This Declaration of Covenants, Conditions, and Restrictions (CC&Rs) binds all unit owners, residents, and tenants. The Association maintains common areas and exteriors; owners maintain interiors and patios.
- Use & occupancy: Units are limited to single-family residential use. Limited home businesses are permitted if not detectable from outside, involve no increased traffic or solicitation, and employ only family members living in the unit. Noxious activities and time-sharing are prohibited.
- Leasing & rentals: Rentals for less than 30 days are prohibited (no transient/hotel use). All leases must be in writing and for a term of six months or less; renewals require board approval. Owners must submit a rental registration form and remain liable for tenant compliance. Tenant violations are grounds for eviction.
- Pets: Common household pets are allowed, but commercial breeding is prohibited. The Board may adopt specific pet rules and regulations.
- Vehicles & parking: Commercial vehicles, RVs, boats, trailers, and unregistered or inoperable vehicles may not be parked on a lot for more than 72 hours unless inside a garage. Cars, light trucks (1-ton rating or less), SUVs, motorcycles, and golf carts may be parked in garages, carports, or driveways.
- Architectural review: All exterior improvements, alterations, or repainting (including fences, walls, windows, antennas) require prior written approval from the Board. Plans submitted to the Board are deemed approved if no response is received within 90 days, but changes that increase a unit's square footage always require approval.
- Maintenance responsibilities: Owners are responsible for maintaining unit interiors, patios, windows, doors, fixtures, and HVAC equipment. The Association maintains all exteriors (roofs, walls, stairways), common areas, landscaping, pool, and off-street parking. Owners must pay for damage caused by themselves, their family, guests, or tenants.
- Assessments & fees: Monthly assessments are set by the Board and may be increased up to 5% per year without a member vote; larger increases require a majority vote. Special assessments need Board approval and ratification by a majority of members. Nonpayment results in interest, a lien on the unit, and potential foreclosure.
