The association maintains common areas and landscaping, funded by equal per-unit assessments. Your use and modifications are subject to strict approval requirements and community rules, including Fountain Hills architectural guidelines.
- What you own & maintain: You own your unit's interior (walls, roof, floor). The association maintains shared common elements. You're responsible for maintaining limited common elements allocated to your unit, typically your yard/patio and utility meters serving only your unit.
- Residential use only: Units must be used exclusively for single-family residential occupancy. No home-based businesses are permitted, though you may maintain personal business records or handle personal calls from your home.
- Architectural approval for structural changes: Nonstructural interior alterations don't require approval. Any structural changes, modifications to exterior color or texture, or new exterior features require prior written approval from the adjacent unit owner, plus compliance with Fountain Hills Committee of Architecture rules.
- External devices & utilities: Solar panels, satellite dishes, antennas, telescopes, or similar devices visible from neighboring property require written consent from the adjacent unit owner. All utility lines must be underground or concealed in buildings.
- Vehicles, trash & outdoor restrictions: No vehicle construction, repair, or service is allowed anywhere visible from neighboring property, and no inoperable vehicles can be parked or stored anywhere visible from neighboring property. Trash must be in covered, town-approved containers; no incinerators, clotheslines, or exterior speakers/horns/bells are permitted.
- Insurance requirements: You must maintain fire, casualty, and liability insurance on your unit at full replacement value. The minimum joint liability between adjacent units is $500,000, or higher if the association requires it.
- Assessments: Common expenses are assessed equally among the two units. Assessment liens are subordinate to first mortgages — if your unit is foreclosed, the new owner acquires it free of unpaid assessments, which may be reallocated to other units.
- HOA governance: During the developer's control period, the developer appoints the board. After that period ends, unit owners elect at least a 2-member board, both of whom must be unit owners.
