This is a condominium declaration for Mirage Condominiums XLI, Inc., a small two-unit condo community in Fountain Hills, AZ. As a unit owner, you own your unit's interior and share ownership of common elements equally with the other unit owner. The association, run jointly by both owners after developer control ends, maintains common areas and enforces rules.
- What you own & maintain: You own the interior of your unit (within exterior walls, slab, and roof) and are responsible for its maintenance. You also maintain limited common elements allocated to your unit, such as the adjoining yard/patio and utility meters. The association maintains the common elements (shared areas).
- Use restrictions: Units are for single-family residential use only. No business or trade is allowed. Outdoor clotheslines, solar collectors, and satellite dishes visible from neighboring property are prohibited without adjacent unit owner consent. No inoperable vehicles may be stored visibly, and no nuisances or offensive activities are permitted.
- Architectural review: An Architectural Committee (appointed by the board) regulates external design and appearance. Structural additions or exterior modifications require prior written approval from the owner of the adjacent unit.
- Assessments: Common expenses are assessed equally between the two units (50% each). The association's assessment lien is subordinate to first mortgages. Delinquent assessments may be reallocated as common expenses after foreclosure.
- Insurance: Each unit owner must maintain fire, casualty, and liability insurance on their unit. Minimum liability coverage is $500,000 jointly with the adjacent unit owner if not otherwise specified. Proof of insurance must be provided to the adjacent unit owner.
- Voting & governance: Each unit has one vote. During the developer control period, the declarant appoints the board. After that, unit owners elect a board of at least two members. Unanimous consent of unit owners is required for many amendments and actions.
- Parking & vehicles: No vehicle repair visible from neighboring property is allowed. Inoperable vehicles may not be stored or parked on any portion of the condominium so as to be visible from neighboring property.
