This is a condominium declaration for Mirage Condominiums XVI, a 2-unit condominium in Fountain Hills, Arizona. You own your individual unit and share ownership of common structural elements maintained by the association, subject to architectural review by both an on-site Architectural Committee and the Fountain Hills Committee of Architecture.
- What you own & maintain: You own your unit's interior and are responsible for its maintenance. The association maintains common structural elements, while you're responsible for your yard and patio (allocated limited common elements); if the association fails to maintain common elements, you must maintain the common elements contiguous to your unit.
- Single-family residential use: Each unit must be used exclusively for residential occupancy by a single family (related by blood, marriage, adoption, or maintaining a common household). No commercial, professional, or occupational use is permitted, though personal business records and calls from your unit are allowed.
- Architectural review & exterior restrictions: Structural alterations and changes to exterior color or texture require written approval from the adjacent unit owner. Solar panels, satellite dishes, antennas, and similar devices cannot be installed where visible from neighboring property without the adjacent unit owner's written consent.
- Vehicle restrictions: Motor vehicles cannot be constructed, repaired, or serviced on the property if visible from neighboring property (emergency repairs excepted). Inoperable vehicles cannot be stored or parked if visible from neighboring property.
- Utilities & outdoor facilities: Utility lines must be installed underground or concealed within buildings. Outside clotheslines and other outdoor clothes-drying facilities are prohibited.
- Insurance requirements: You must maintain fire, casualty, and liability insurance on your unit at full replacement value. You and the adjacent unit owner must jointly maintain at least $500,000 in liability insurance.
- Assessments: Common expenses are assessed equally to each unit.
