- What you own & maintain: You own your unit's interior (bounded by exterior wall surfaces, slab bottom, roof top, and half the party wall) and must maintain and repair it at your expense. Your exclusive yard and patio (called Limited Common Elements) are also your direct responsibility to maintain, not the Association's.
- Alterations and approvals from adjacent unit owner: Nonstructural interior changes don't require approval, but you remain liable for damage to other units or common areas. Structural changes, modifications to exterior color or texture, and any solar panels or satellite dishes visible from neighboring property require prior written approval from your adjacent unit owner.
- Use restrictions: Units are exclusively for single-family residential use—no business, trade, or profession can be conducted, though you may keep personal professional records or handle business calls. Prohibited: outside clotheslines, motor vehicle repair or storage of inoperable vehicles visible from neighboring property, and trash outside covered containers approved by the Town of Fountain Hills.
- Insurance requirements: You must carry fire, casualty, and liability insurance on your unit at full replacement value with an insurance carrier rated B+ or better. You and your adjacent unit owner must jointly maintain at least $500,000 in liability coverage, and you must provide proof of insurance to your adjacent unit owner.
- Assessments and common expenses: Each unit pays an equal 50% share of common expenses budgeted by the Association. Assessment liens are subordinate to first mortgages, meaning a foreclosed unit can be purchased free of unpaid assessments; those costs may be reallocated to the remaining unit owner.
- Common element maintenance: The Association is responsible for maintaining common areas. If it fails to maintain them, each unit owner must maintain the common elements contiguous to their unit (effectively splitting responsibility down the middle). Your yard and patio are your direct responsibility as allocated Limited Common Elements.
- Architectural oversight: The community is subject to oversight by both the HOA's Architectural Committee and the Fountain Hills Committee of Architecture (established under separate county restrictions). When the two committees' requirements conflict, the more restrictive rules apply.
