Mirage Condominiums V (Fountain Hills, AZ) is a condominium community where you own an individual unit and share ownership of the building's common elements, which the association maintains and insures through per-unit assessments. The community is subject to both its internal Architectural Committee and the Town of Fountain Hills Committee of Architecture. Initially two units (6A, 6B), with developer rights to expand.
- What you own & maintain: You own your unit's interior; the association maintains common elements and carries master insurance. You're responsible for your allocated limited common elements (yard, patio, or balcony shown on the plat) and for repairs resulting from your negligence.
- Assessments & fees: Common Expense Assessments are allocated equally per unit. The initial maximum is $10/unit; subsequent years increase by the Consumer Price Index without a vote, or greater increases require a 2/3 owner vote. Delinquent assessments bear 12% annual interest or the prevailing FHA/VA rate (whichever is higher) plus a $10 late charge. The association has a lien on your unit to secure unpaid assessments.
- Alterations & improvements: Nonstructural changes inside your unit need no approval, but you're liable for damage to other units or common elements. Structural alterations require architectural committee approval plus a licensed Arizona architect/engineer's certification that the work won't impair the building. Any exterior-visible changes—even interior ones—require adjoining unit owner approval.
- Residential use & restrictions: Units are for single-family residential use only; no commercial business is permitted (personal business records or calls from your unit are OK). No outdoor clotheslines, temporary structures for living, mineral exploration, or servicing/repairing vehicles visibly from outside. Trash must be in covered containers approved by the Town of Fountain Hills.
- Utilities & infrastructure: Utility lines must be underground or concealed in buildings—no visible aerials, satellite dishes, TV/radio antennas, or solar devices without architectural committee approval. Utility easements run through common elements for maintenance and repair.
- Architectural review (two authorities): Both an internal Architectural Committee and the Town of Fountain Hills Committee of Architecture have authority over exterior design and appearance. If their rules conflict, the more restrictive rules apply.
- Governance transition: During the "Period of Declarant Control" (90 days after 75% of units sell OR 4 years after the developer stops marketing units, whichever comes first), the developer appoints the board. After that, unit owners elect a board of at least three members (all must be unit owners).
