- What you own & maintain: You own the interior of your unit, including interior partitions and fixtures. The association maintains all common elements (like the building exterior, roof, and grounds). You are responsible for maintaining your unit and any limited common elements (like your patio/balcony and any meters serving only your unit).
- Single-family residential use: Units must be used exclusively as a residence by a single family (defined as persons related by blood, marriage, adoption, or a group maintaining a common household). No business, trade, or other nonresidential use is allowed on the property.
- Architectural review: You need prior written approval from the Architectural Committee for any structural additions, alterations, or improvements, and for any change visible from the exterior. Nonstructural interior changes do not require approval. The community is also subject to the Fountain Hills Committee of Architecture; the most restrictive rule applies.
- Exterior restrictions: No solar panels, satellite dishes, or antennas visible from neighboring property without approval. No outside clotheslines, trash containers only in approved covered containers, and no temporary structures for residence. Motor vehicles may not be repaired where visible, and inoperable vehicles may not be parked in visible areas.
- Assessments & fees: Common expense assessments are levied per unit (equal 50% interest). The board may increase assessments up to the consumer price index limit without a vote; larger increases require a 2/3 vote. Special assessments also require 2/3 approval. Delinquent assessments accrue 12% interest and a $10 late fee, secured by a lien on the unit.
- Nuisances & lawful use: No nuisance, offensive activity, or illegal use is permitted. You must comply with all laws and zoning. No exterior sound devices (except security). Diseases or insects that could harm plants must be prevented.
- Declarant rights (developer): The developer (Declarant) retains special rights during the Period of Declarant Control, including the ability to add phases, appoint the board, maintain sales offices, and use easements for construction. This period ends when 75% of units are sold to non-declarant owners or 4 years after sales cease.
