What Paradise Reserve's governing documents say
Paradise Reserve is a master-planned community in Paradise Valley, Arizona (originally called Lincoln 40) divided into two villages, where residents own individual Lots and share common areas managed by an association. This is the Third Amendment (2009) to the community's Covenants, Conditions & Restrictions, updating rules on design approval, storm drainage, retaining walls, and cost assessments—but not the complete governing rulebook.
- Community structure & governance: Paradise Reserve has two villages (A and B) with a nonprofit association managing shared property and infrastructure. During the initial development phase, the Developer has significant voting control; once development ends, residents assume control and establish separate Design Review Committees for each village.
- Voting power & monthly assessments: Voting power and costs differ between villages: Village A Lots each have 2.285 votes and pay an equal share of 40% of common expenses; Village B Lots each have 1 vote and pay an equal share of 60% of common expenses. During development, the Developer holds 46 votes per Lot, giving them controlling power until property sales end.
- Storm drainage through your Lot: The Association has the right to install and maintain storm drain systems through portions of Lots 5, 6, 7, 9, and 14; owners of these lots must grant the Association access to these areas for maintenance. You cannot obstruct or interfere with this drainage work.
- Retaining walls & maintenance responsibility: Retaining walls built on or crossing Lots 3–14 in Village A (and potentially some in Village B) are the Association's responsibility to maintain and repair. The Association has the right to enter these Lots as needed to access and maintain the walls.
- Architectural review & design approval: Before making any changes or improvements on or near common areas, you must get approval from the Design Review Committee (separate committees serve each village). The Association can enforce compliance if you make unapproved changes.
- Shared driveway (Lot 11–12): Lot 12 has the right to use a driveway crossing Lot 11. The two owners must split maintenance and repair costs equally; if one owner fails to maintain it, the other can perform the work and charge 50% of the cost (or 100% if the failure was due to the first owner's negligence).
- Open space preservation areas: Portions of multiple Lots (1–5 and 8–14) are designated as permanent open space that must remain natural and undeveloped. The Association maintains these areas, and they are also subject to federal environmental regulations.
