This is a set of declarations of covenants, conditions, and restrictions (CC&Rs) for specific final plats within the master-planned community of Fountain Hills, Arizona. The documents govern single-family residential lots, establishing an architectural review committee and land-use regulations that run with the land. Homeowners, buyers, and residents are bound by these rules, which are supplemented by a master declaration for Final Plat No. 101.
- Architectural review: All plans for structures must be submitted to a Committee of Architecture (five members, one must be a Maricopa County resident) for approval. The committee enforces design standards and may adopt additional rules.
- Lot use & zoning: Lots are designated as R1-35, R1-8, or R1-43 single-family residential. Minimum lot area is one acre, with required setbacks (front yard 40 ft, side yard 30 ft, rear yard 40 ft). Maximum building height is 30 ft or two stories. Lot coverage is capped at 15%, and minimum living area is 2,000 square feet (excluding patios, garages, etc.).
- Utility easements: A five-foot strip along all side and rear lot lines is reserved for public utilities, communication cables, and drainage. The declarant may assign these rights.
- Covenant duration & enforcement: The conditions run for 25 years from the 1973 recording, then automatically renew for successive 10-year periods unless a majority of lot owners vote to change. Violations can be enforced by any lot owner or the declarant through legal action.
