Mirage Condominiums is a 2-unit condominium in Fountain Hills, AZ — you own your unit's interior and share the building's common elements, which the association maintains and insures. Each unit has equal votes and pays equal common expenses. The declaration is subject to the Arizona Condominium Act and the Fountain Hills architectural committee.
- What you own & maintain: You own your unit (interior surfaces, fixtures within boundaries). Limited common elements (patios, exterior doors, windows) are for your exclusive use and you maintain them. Common elements (roof, foundations, land) are maintained by the association. You must maintain your own unit and limited common elements.
- Use restrictions (single-family residential): Each unit and limited common elements may be used only for residential purposes by a single family (persons related by blood, marriage, adoption, or a group maintaining a common household). No business, trade, or nonresidential use is allowed, though personal professional activities like a home office are permitted.
- Architectural alterations: Nonstructural interior alterations do not require prior approval of the adjoining unit owner. Structural additions, exterior changes (color, texture), or modifications visible from neighboring property require the adjacent unit owner's written approval. The Fountain Hills Committee of Architecture also has jurisdiction.
- Parking & vehicles: No major vehicle repairs (beyond emergency) or inoperable vehicles are allowed on the condominium if visible from neighboring property.
- Assessments & fees: Common expenses are split equally between the two units (50% each). The association adopts a budget and assesses each unit its share. Assessment liens are subordinate to first mortgages.
- Insurance requirements: Each unit owner must carry fire, casualty, and liability insurance on their unit at full replacement value. Minimum liability coverage of $500,000 is required jointly with the adjoining unit owner. Proof of insurance must be provided to the adjoining unit owner.
- Rights of first mortgagees: First mortgage holders have extensive rights, including notice of defaults, insurance changes, and approval over material amendments to the declaration. No right of first refusal for unit sales is allowed. Mortgagees can inspect records and receive financial statements.
- Enforcement & neighbor relations: The association or any unit owner can enforce the declaration. If the association fails to maintain common elements, a unit owner may require each owner to maintain their adjacent common area. Disputes between adjoining unit owners may involve mutual approval for exterior changes.
