Via Con Dios is a condominium community in Sun City, Arizona. This document contains amendments to the community's Declaration of Restrictions approved by 67% vote in 2009—not a complete rulebook, but specific changes addressing board governance, common-area responsibility, emergency access, and strict rental limits.
- What you own & maintain: You own your unit's interior; the association maintains all common elements including land, facilities, utilities, and streets. Limited common elements attached to your unit (like exterior patios) are your responsibility but must comply with association design and landscaping standards.
- Leasing & rentals: New rentals are prohibited. Only owners actively renting at the time this amendment was adopted may continue renting—but that right ends if you sell, die, or stop renting. The Board may approve hardship leases (6 months to 1 year) at its sole discretion for cases involving death or transfer.
- Board governance: The Board must have at least three managers who elect a chair and co-chair from among themselves. A board majority can authorize most actions, except those requiring full owner membership approval under the governing documents.
- Emergency access: The Board Chair or other board member may use an emergency key to enter your unit without permission in case of fire, water damage, medical emergency, or other urgent situations when the owner cannot be reached.
- What this document doesn't cover: This is an amendment only, not the full Declaration of Restrictions. It does not address monthly fees, utilities, age restrictions, amenities, or other architectural and behavioral rules that may be in the complete governing documents.
