The Oaks at Fall Creek is a single-family home subdivision in Hood and Johnson Counties, Texas. These Covenants, Conditions & Restrictions (CCRs) apply to all lot owners in Phases One and Two, governing what you can build, how you can use your property, and what is required to maintain the rural residential character.
- Architectural review: All exterior construction, fences, walls, and alterations must be approved in writing by the Architectural Control Committee. Plans must show structural details, color, materials, and location. The committee can reject plans not meeting design or aesthetic standards.
- Use restrictions: Tracts may be used only for residential purposes. No commercial activity is allowed, but limited home-based businesses (professional offices, hobby businesses) are permitted if contained within the residence and not causing excessive noise, traffic, or unsightly conditions.
- Minimum dwelling size & construction standards: Each main dwelling must have at least 1,800 square feet of living area (excluding open porches and garages). At least 50% of exterior wall area must be brick, stone, masonry veneer, or glass. Only new construction materials are allowed; no mobile homes, modular homes, or moved buildings are permitted.
- Setbacks & building height: Buildings must be set back at least 150 feet from front property lines and public roads, and 50 feet from interior side/rear lines (subject to waiver). No building may exceed 2½ stories. Construction must be completed within 6 months of starting foundation.
- Animals & livestock: Swine are prohibited except for one animal for 4-H/FFA projects. No commercial feedlots or kennels. Livestock and household pets are allowed, but no more than 2 mature animals per 5 acres. Pets may not be kept for commercial purposes.
- Vehicles & storage: Trucks over 2 tons, inoperable/unlicensed vehicles, and vehicles carrying flammable cargo may not be stored visibly outside. Campers/RVs may stay only 14 consecutive days before a permanent dwelling is built; after that, they must be stored out of sight from public roads. No overnight parking on interior subdivision roads.
- Fencing & signage: All fences need prior written approval from the Architectural Control Committee. Fencing along roadways must be permanent material (pipe, cable, rock, etc.); barbed wire is prohibited along public roads. Only one sign of up to 5 sq. ft. is allowed during construction and sales.
- Nuisances & maintenance: Tracts must be kept clean, free of trash, and mowed regularly. No noxious or noisy activities. Burning requires approval from the nearest volunteer fire department. Pesticides cannot contaminate creeks or stock tanks.
