Gilburr Estates is a single-family residential subdivision in Mesa, AZ, governed by a recorded Declaration of Restrictions from 1972. This document sets minimum home sizes, setback rules, fencing limits, and use restrictions that apply to all lot owners. These covenants run with the land and automatically renew every 10 years unless a majority of owners votes to change them.
- Architectural review: All architectural drawings must be approved by D.S.I., Incorporated before any construction.
- Minimum home size: Every single-family dwelling must have a ground floor area of at least 1,400 square feet, not counting open porches or attached garages.
- Setbacks and building placement: Front walls must be between 25 and 65 feet from the front property line; side walls at least 5 feet from side lot lines (3 feet for open carports with frame storage); rear one-third of lot exceptions apply. Owners who combine adjoining lots may treat them as one lot.
- Fences and hedges: No solid wall or fence over 3 feet high may be placed nearer the front street than the residence’s front wall (or within 20 feet of the front line if no residence exists). Side and rear fences may be up to 6 feet high. Hedges over 3 feet are not allowed within 20 feet of the front lot line.
- Livestock and poultry: No livestock or poultry may be kept on any lot.
- Guest and servant quarters: Garages or other buildings may include guest or servant quarters, but such buildings may not be used as primary residences.
- Duration and amendment: These restrictions run with the land and were originally set to expire on January 1, 1982, but are automatically extended for successive 10-year periods unless a majority of lot owners votes to change them.
- What this document doesn't cover: This is only the original 1972 Declaration of Restrictions. It does not include any later amendments, association bylaws, or rules that may have been adopted by a homeowners' association. For current rules, check with the HOA or county records.
