This is an Antenna Resolution and Policy for Dream Creek Condominiums, a condominium community in Phoenix, AZ. It supplements the main Declaration of Covenants, Conditions and Restrictions (CC&Rs) and governs the installation, use, and maintenance of satellite dishes and antennas in accordance with FCC rules. The policy applies to all owners, tenants, and occupants, with the owner ultimately responsible for compliance.
- Allowed antennas: Three types are allowed without prior Architectural Committee approval: DBS antennas 1 meter or less in diameter, MDS antennas 1 meter or less, and antennas for receiving television broadcast signals. Larger DBS/MDS antennas and all other types require Committee approval.
- Location and installation rules: Antennas must not encroach on common area or another's property. If possible, must be placed inside where acceptable signal is received. Otherwise, must be shielded from street and neighbors to the maximum extent, and painting to match structure is required (if it doesn't impair signal or void warranty). Masts over 12 feet above roofline need prior approval. All installations must comply with building codes and manufacturer's instructions.
- Maintenance and liability: The owner bears all costs of installation and maintenance, and is responsible for any damage or injury caused by the antenna. The owner must indemnify the association and keep the antenna in good repair.
- Notification and fines: Owners must submit a notification form within 5 days of installing an allowed antenna. For violations, a $50 fine per violation plus $10 per day if not corrected. The association may seek injunctive relief for immediate safety hazards and recover attorney fees.
