Kay Acres Unit V is a standard single-family home HOA community in Phoenix, AZ. Homeowners own their lot and home; the association maintains common areas. These covenants, conditions, and restrictions (CC&Rs) bind all owners, residents, and guests.
- Residential use & home businesses: Each lot is for single-family residential use only. A single family means persons related by blood/marriage/adoption, or up to three unrelated persons. Home businesses are allowed only if not detectable from outside, no more than one non-resident employee, and no excessive traffic or noise.
- Architectural review: Any exterior modification visible from neighboring property requires prior written approval from the Board (or Architectural Committee). Requests must be submitted with plans; the Board has 45 days to approve or disapprove. Fees may apply. No structure may be placed on a lot without approval.
- Pets: Reasonable numbers of dogs, cats, and common domestic birds allowed as pets, but not for commercial purposes. Pets must be leashed (max 6 ft) when off the lot, and droppings must be removed. No pet structure visible from neighboring property. The Board can further restrict size/number.
- Parking & vehicles: Commercial vehicles (trucks over 1-ton, RVs, boats, trailers) cannot be parked in sight of neighboring property without Board approval, except for temporary loading. Family vehicles must be parked in the garage if possible; otherwise can be in driveway. No inoperable or stored vehicles in sight. Parking on private courtyards must not block access.
- Leasing & rentals: Owners may lease their lot, but leases must be in writing, for at least 30 days, and tenants must comply with all governing documents. A transfer fee is due upon lease execution. Home exchange programs with no/nominal consideration are not considered leases.
- Assessments & fees: Annual assessments are levied equally on all lots. Increases over 20% from the prior period require majority member approval. Special assessments may also be levied. Delinquent assessments incur liens, late fees, interest, and collection costs. The Board can suspend common area use and voting rights for nonpayment.
- Signs & antennas: No signs visible from neighboring property except: required legal signs, one for-sale/for-lease sign (standard size), small alarm sign, and Board-approved signs. Satellite dishes are permitted but subject to reasonable rules; ground-mounting is preferred unless signal requires roof. Solar panels are allowed but must be screened.
- Nuisances & maintenance: No rubbish, odors, loud noises, or nuisances allowed. Owners must keep their lot and improvements in good repair. Trash containers can be at the curb only 12 hours before/after collection. No clotheslines visible from neighboring property. Garages must be used for parking, not living space.
