It establishes reciprocal easements and maintenance obligations among the owners of three parcels, and is binding on all current and future owners, lessees, and occupants. It is not a residential community; it governs a retail/office development.
- Use restrictions: The Center may be used for commercial purposes only, limited to retail and office space. Buildings are limited to two stories in height.
- Common area & easements: Each parcel has non-exclusive easements over the common areas of all parcels for parking, ingress/egress, and utilities. No walls, fences, or barriers may obstruct these easements.
- Maintenance obligations: Each owner must maintain the common area on their own parcel in a safe, sightly, and serviceable condition, including surfacing, cleaning, lighting, landscaping, and utilities. They may agree in writing to share maintenance expenses.
- Parking: Each owner must maintain the requisite number of automobile parking spaces on their parcel as shown on the site plan or required by law.
- Duration & amendments: The Declaration runs for 75 years from November 1994 (through approximately 2069) and may be terminated, changed, or amended only by a written agreement executed by all record owners of the parcels and all mortgage lien holders.
- Default & enforcement: If any owner defaults, another owner Beneficiary must give written notice and at least 30 days to cure. The non-defaulting owner may cure the default and recover costs plus interest, and the unpaid amount becomes a lien on the defaulting party's interest.
