What Cleburne Station Block's governing documents say
This is an ancillary document (an 'Acknowledgement of Use and Approval of Development Plans') for a specific commercial lot within the Cleburne Station master-planned community. It does not contain the full community rules but instead grants approvals and modifications to the underlying Declaration to allow a 7-Eleven convenience store with fuel sales on that parcel. The document binds the property owner (HW Cleburne, LP) and the association, and gives 7-Eleven certain rights.
- Approved use of the HW Property: The lot is approved for a convenience store with retail sale of motor fuels, including fuel storage and dispensing, as long as it complies with applicable laws. This use is deemed not a violation of the Declaration's restrictions (including Section 7.20).
- Modification of Declaration restrictions: The Declaration's restrictions on outside sales areas, screening requirements (Sections 7.11, 7.12), and any other restrictions that would conflict with the approved use are overridden for this parcel. Items such as outdoor storage under canopies and adjacent to fuel dispensers are allowed without screening.
- Approved plans and specifications: The architectural, civil, landscape, and sign plans (attached as exhibits) are approved by the Declarant and Association. No further consent is needed for those plans under the Declaration.
- Landscape plan compliance: The landscape plans (Exhibit B-3) satisfy Sections 7.13 and 7.14 of the Declaration regarding parkway landscape areas.
- Enforcement and amendment rights for 7-Eleven: As long as the lease is in effect, 7-Eleven can enforce the Declaration, Access Easement, Sign Easement, and Restrictive Covenant as if it were an owner. Any amendment or modification to those documents requires 7-Eleven's consent. Voting rights of the owner for the HW Parcel are delegated to 7-Eleven.
- What this document doesn't cover: This is not the full community CC&Rs. It does not cover rules for residential lots (e.g., age restrictions, pet limits, leasing restrictions, maintenance responsibilities, or assessment amounts). Those would be in the main Declaration for Cleburne Station.
