What Biltmore Terrace Condominium Association's governing documents say
Biltmore Terrace Condominiums (Paradise Valley, AZ) is a condominium community — owners own individual units and share the common elements. This document is a partial amendment to the community's Declaration (CC&Rs), specifically updating the rules for special assessments. It is not a complete rulebook; the full governing documents may contain other rules not covered here.
- Special Assessments: Special assessments (for capital improvements or other lawful purposes) require approval by two-thirds (2/3) of all eligible votes, with owners current on regular assessments eligible to vote. Unless otherwise directed by the Board, special assessments are due 30 days after levy and notice.
- One-Time Special Assessment (2006): A one-time $4,500 special assessment was levied per unit as of December 31, 2006, for maintenance/replacement of capital improvements to common areas. Owners had three payment options: pay by 12/31/2006 with a 10% discount ($4,050); pay $1,500 annually for three years; or pay $125/month for 36 months. Unpaid assessments could be enforced like regular assessments, and full payment was required before selling the unit.
- What this document doesn't cover: This amendment only addresses special assessments. It does not cover rules on leasing (e.g., minimum lease terms), pets, unit maintenance, architectural changes, parking, or other typical HOA restrictions. You will need to review the original Declaration and any other amendments for those rules.
