What Homestead HOA's governing documents say
These are the Bylaws for the Homestead at Marley Park Community Association, a planned community in Tempe, AZ. They govern how the association is run—board elections, meetings, voting, and enforcement—but do not contain the community's use restrictions (like pet or rental rules). Homeowners and buyers should consult the Declaration (CC&Rs) for those details.
- Membership & voting: Two classes of members: Class A (all owners after developer control ends) and Class B (developer). Voting is by lot, one vote per lot. Quorum for member meetings is 10% of Class A votes. Proxy voting is prohibited after developer control ends. Written ballots are allowed and must be delivered at least 7 days before meeting.
- Board of directors: Board size can be 3, 5, or 7 members. Directors serve 2-year terms, must be at least 18, and cannot be delinquent on assessments or in violation of governing documents. During developer control, the developer appoints all directors. After control ends, Class A members elect all directors. A director can be removed by member vote (majority) or by board for three unexcused absences or delinquency over 30 days.
- Meetings & notice: Annual member meetings are set by the board. Special meetings can be called by petition of 10% of Class A members. Written notice must be given 10–50 days before a meeting. Board meetings are open to members except in executive session for sensitive matters. Board meetings require 48 hours' notice posted on property.
- Enforcement & sanctions: The board can impose sanctions for violations. Process: written notice describing the violation and proposed sanction, then a 10-business-day period to request a hearing. If no timely request, sanction is imposed. The board may also use self-help (e.g., towing) or sue without following the hearing procedure.
- Amendment process: During developer control period, the developer (Class B member) can amend bylaws unilaterally. After control, amendments require a majority vote of Class A members and developer consent if still a member. Certain amendments by developer are allowed without member vote for compliance with law or lender requirements.
- What this document doesn't cover: These bylaws contain no rules on pets, rentals, parking, architectural changes, or age restrictions.
